 Pups produced by AGAINST THE WIND KENNELS  are guaranteed for life against congenital defects. These defects include (but are not limited to), HIP DYSPLASIA, BLINDNESS, DEAFNESS, DEMODECTIC MANGE, ENTROPIAN OR ECTROPIAN, HEART DISORDERS, ETC.
If your ATWK pup/dog has one of these defects, you will be entitled to a replacement pup from a breeding of your choice here. Stud Service can be had instead of a pup at the owners discretion. **NO CASH REFUNDS** unless I am no longer breeding dogs. Then full purchase price of pup will be vrefunded- not shipping costs. Requirement of Veterinarian Verification, stating the problem. The problem/fault cannot be due to nutrition, improper exercise, fighting or bad care or unproved genetic fault.

If owner wants to return the pup/dog, they are to pay all shipping/health certificate expenses.
Pups are guaranteed for 2 weeks from the date of delivery against infectious diseases, such as PARVOVIRUS, BORDETELLA, CORONAVIRUS, PARAINFLUENZA, DISTEMPER, LYMES DISEASE, ETC. When you receive your puppy it will have had all possible precautions against these diseases. It is up to you, the new owner; to continue a good vaccination schedule.

 

RIGHT OF 1ST REFUSAL: if circumstances arise that the new owner is not able to keep the dog/puppy & needs to sell/give it away, they will call AGAINST THE WIND KENNELS first. If owner has a buyer already lined up, give ATWK a chance to match the price. If giving away, please call me before giving it to the crackhead down the street or taking to the dog pound or the "Humane" Society. Humane Society Refugees welcome, (my bloodline or not). AGAINST THE WIND KENNELS will extend this clause to every pup sold I feel like this may help save some of my dogs from irresponsible owners and the death squad at the Humane Society.
There is no real way to govern this; every person is as good as their word! Please give this serious consideration!!

INCENTIVES

The dogs I produce here at AGAINST THE WIND KENNELS should be able to compete in various competitions. These dogs are highly trainable and new owners are urged to compete with their dogs. Whether it's in the show ring, weightpulling, Schutzhund, etc.
To that extent I am proud to extend this guarantee! If any pup purchased from AGAINST THE WIND KENNELS should achieve titles in any of the following:

ADBA, UKC SHOW CHAMPION -$100

ADBA, UKC WEIGHTPULLING ACE-$100

SEARCH & RESCUE (SAR) CERTIFIED-$200

Depending on titles/certificates earned, the owner of said pup shall receive cash rewards, a pick pup from the breeding of their choice, or a stud service to the stud of their choice ABSOLUTELY FREE!! ALL PUPPIES WILL BE UP TO DATE ON THEIR SHOTS AND WORMING WHEN SOLD AND COME WITH A WRITTEN CONTRACT AND HEALTH GUARANTEE!!

IMPORTANT: Those owners with sound ethics and a life-long  dedication to the safety and protection of their dog and the American Pit Bull Terrier as a breed, need have NO concern or fear of this contract. 

This is a serious contract designed to protect primarily the puppy, but also as the breeder I am placing my kennel name in the hands of the proud new owners,the breed (which is in mortal danger from unethical breeders & uncaring owners),and yes,YOU the new owner will be paying hard earned money for an AGAINST THE WIND KENNELS  puppy and YOU want that puppy to be of excellent temperament, conformation, and health.

We provide discounts and other benefits to those who show our puppies.

All questions and concerns must be addressed  prior to the submission of any deposit and/or purchase funds.  All dogs from ATWK   MUST be family dogs, raised and socialized as part of a family not as outdoor dogs or kennel dogs.  Dogs are pack animals and they must part of a close knit family pack to maintain emotional and mental stability.  

The reference, in this document, of dog (DOG) shall be the one referred to above, the breeder shall be ATWK(Our Names), the buyer shall be referred to as the owner or co-owner.

If within 72 hours of the date of sale  you believe the dog to be sick, you agree to return it to us at your own expense and we will refund the purchase price (less deposit) or return the dog to you in well condition.  Should the puppy die, the buyer must supply the breeder with a veterinarians' statement of cause of death and any treatment given. If death is caused by accident or poisoning purchase price will not be refunded. The breeder will not be responsible for any veterinarian bills or other bills the owner may incur after the purchase of the dog.

All dogs carry a guarantee against veterinarian proven "genetic" health defects (hips and eyes), this guarantee is only against proven inherited disorders that would dramatically shorten the normal life-span of said dog.  The dog owner will be granted a puppy pick from any breedings desired or use of stud servic- owner's choice. NO CASH REFUNDS.

If Dog is an unspayed female (unneutered male). To maintain Seller's kennel reputation and bloodline, Buyer specifically covenants and consents to the following:

1.Rewards shall be given for any titles such as CH($50), GR CH($100). For titles ACE, ACE of ACE & UCD owner will be entitled to a free puppy pick from any ATWK breedings desired. Also CGC & TT certifications will recieve($25) each.

2.All breedings of dog must be for betterment of the breed and     following the UKC/AKC and/or Parent Club Breeder Code of Ethics. http://www.ukcdogs.com/ethics.html

3.Dog and bitches shall only be bred to stud dogs and/or bitches registered with numerous titles in pedigree (CH, ACE, WD, UCD) by the United Kennel Club (U.K.C.) or ADBA.

4.Buyer shall, upon violation of these provisions or any other within this contract, immediately forfeit dog and dog's registration papers to Seller, and pay to Seller all costs and attorney fees to enforce this covenant, plus $10,000 (ten thousand dollars) in liquidated damages.

5.Buyer specifically agrees, that neither Dog, nor Dog's offspring be registered with the AAPBA (All American Pit Bull Association), AADR (All American Dog Registry) or their derivative or successor organization(s), without the express written consent of Seller. Should the Seller grant such consent, dogs shall only be "Single" registered. If Buyer or her successors or assigns violate this covenant, Buyer shall pay to Seller $12,500.00 in liquidated damages, plus all attorney fees and costs.

6.Under no circumstances shall Buyer, successors or assignees, allow dog's papers or pedigree to be used to falsely register another dog within any dog or pet registry. Should Buyer violate this covenant, Buyer shall be liable to Seller for $15,000.00 in liquidated damages, plus all attorney fees and costs incurred to achieve a remedy. Buyer specifically agrees that no judgment for liquidated damages shall be dischargeable in bankruptcy.

7.Owner herewith specifically grants Power of Attorney to breeder, to allow breeder in owner's name to claim the dog who is the subject of this contract from any Animal Shelter, Animal control facility, Humane Society, SPCA, or Animal Rescue facility, should the dog be held in any such place or facility. Owner holds the sheltering authority, agency, or party harmless for turning over the dog to breeder.

8.Accepted show organizations and registries are UKC, IWPA, AKC CKC, ADBA, International, and American Rare Breed only, the dogs will not be registered or shown with any other registry without prior written permission from AGAINST THE WIND KENNELS or the breeder has the right to take the dog back from the owner/co-owner with no compensation to the owner/co-owner.

9.The breeder reserves the right to inquire about and inspect the dogs housing and quarters at any given (reasonable) time. If the breeder finds the dog in an unsanitary and/or in poor health condition, the breeder has the right to take the dog back from the owner with no compensation to the owner.

We the breeder are now the grandparents of your new puppy and as grandparents we appreciate all news related to our progeny especially pictures, brags, news of accomplishments, problems with training or anything we could help with.

You as the new owner have a great 10+ year responsibility to maintain your dogs emotional and physical well-being.

Maintain a sound feeding program.

Owner agrees to Insure continued health of the dog or bitch by regular veterinarian check-ups.

Maintain proper immunization and keep them up to date. http://duke.usask.ca/~misra/virology/stud2000/vacdogcat/canine.html   For the first month, plan on keeping puppy at home (except for visits to the vet and short trips to accustom him to riding in the car) until he/she is at least 16 weeks old. This is because puppies get their initial immunity to disease from their mother. As the pup grows, he is vaccinated for continued protection from several potentially fatal viruses and bacterial infections. However, there is usually a gap in protection as mother's immunity decreases and administered immunity increases to a safe level. APBTs REQUIRE daily exercise for mental and physical well-being. Lack of proper exercise will result in the dog seeking other ways to release pent up energy such as chewing your shoes, furniture, walls or any other available and expensive item. Our dogs go on daily walks, weight pull, chase tennis balls, go hiking etc.   This will continue until they go across the rainbow bridge.

The responsibility, love, and care you give your dog will be returned many times in the years ahead.

 

By signing this contract you are also stating the following:

If for any reason you as the owner cannot or do not wish to keep this animal, you will contact the breeder 60 days before disposing of or giving this animal away. In the event that you plan to dispose or give the dog away, you agree to provide the breeder the guaranteed right to take the dog back without refunding of purchase price.  

Should Buyer/or John Does violate this covenant, Buyer/and all other John Doe shall be liable to Seller (breeder) for $15,000.00 in liquidated damages, plus all attorney fees and costs incurred to achieve a remedy or get the dog back to breeder.

Any deletions or changes to this contract shall be lined out and initialed by both parties, additional amendments will be noted on the back of this sheet followed by the signature of both parties.

ALL DOGS HAVE A $200.00 (Two hundred dollar) NON-REFUNDABLE DEPOSIT. This deposit will not be returned SHOULD THE BUYER CHANGE THEIR MIND, falsify any information provided to Breeder, OR RETURN THE DOG FOR ANY OTHER REASON THAN THOSE MENTIONED ABOVE.

I/We (the owner) agree never to use or allow this animal to be used for any inhumane, immoral, or illegal purposes, I/WE agree to this contract and agree to abide to every letter and we the owner indicate this by my/our signature below.
